By purchasing the Buy-Back Guarantee, the buyer agrees to all the following terms and conditions:

Initiating the Buy-Back Request:

• The request must be formally initiated by the buyer via email no later than the 14th calendar day after the online purchase date.
• The equipment must be fully paid for and physically located on the buyer’s property when the buy-back request is initiated.
• The vehicle must not have been transferred or sold to any third person or entity at any time after the online purchase date.

Inspection and Confirmation:

• A confirmation of the vehicle’s eligibility will take approximately 14 days.
• An official inspection will be ordered and reviewed by the Program Administrator to validate the current condition against the equipment details at the time of online purchase.

Conditions for Final Eligibility:

• The vehicle’s current condition must be the same or better than indicated on the Equipment Details Page at the time of purchase.
• The equipment must qualify for inspection under Westside Truck Sales Terms & Conditions at the time of the buy-back request.
• The Buy-Back Guarantee cannot be added or removed after the initial purchase.

Refund Processing and Vehicle Pickup:

• Once the buy-back is confirmed, the buyer will be notified, and a refund will be processed within 24 to 48 hours after Tomas Truck Sales’ receipt of the transferable title from the buyer.

• The repurchased equipment will remain on the buyer’s lot until it is picked up by a Tomas Truck Sales representative (a period of approximately 7 days after the buyer receives the refund).

• The buyer must use commercially reasonable care in storing the machine safely, consistent with industry standards, during this period.

• The buyer remains responsible for any damage or loss of the equipment after it has been repurchased until it is picked up from the buyer’s property.
• The buyer must fully support the remarketing process as necessary, including, but not limited to, granting inspection access, providing photographs, and facilitating vehicle pickup.
